1. The Festival will take place at the European Budo Centre Dojo Stara Wieƛ, Stara Wieƛ 1, 97-570 Przedbórz, Poland. It is intended for adults. A participant is a person with a confirmed place booked in their name; a buyer is the person or entity entering into the contract.

2. The programme includes lectures, practising Shiatsu and bodywork on one another, breathing exercises, Qigong / Tai Chi and meditation. It is educational: it does not constitute diagnosis, treatment, rehabilitation or psychotherapy. Participation does not confer any professional or medical qualifications.

§ 2. Purchase and Services Included

1. Before purchasing, read the information available on the Event website and/or social media, which specifies the total price and currency, programme, times, session languages, required preparation, workshop limits, accessibility, and payment method and deadline. This information also states whether accommodation and meals are included in the price and/or provides other details. These Terms and Conditions form part of the contract. Both these Terms and Conditions and the Event programme may change.

2. The contract is concluded when, following successful payment, you receive an email confirming acceptance of your order. An automated acknowledgement that the form has been submitted does not in itself mean that a contract has been concluded.

3. We do not add fees that have not been agreed. Costs for travel to the venue, insurance and personal expenses are not included. We will provide invoices/receipts in accordance with the sales instructions and applicable law.

4. When purchasing for another person, act with their authorisation and give them the offer and these Terms and Conditions. The Organiser discloses information about personal data only to the extent necessary to provide the service and does not disclose such data to third-party individuals or companies. The Organiser is not liable for errors made by people acting as intermediaries in purchasing a ticket / place.

§ 3. Withdrawal, Cancellation and Refunds

1. For distance purchases, the Organiser grants 14 days from the conclusion of the contract to withdraw without giving a reason. It is sufficient to email an unambiguous statement to the address in § 1 before the deadline. Use the word “Cancellation” as the email subject line.

2. Cancellation does not limit statutory rights. You retain your statutory rights to terminate the contract, including for important reasons where provided for by law.

3. Up to and including 10 June 2027, you may transfer your entire unused place free of charge to another adult who meets the conditions of the offer and accepts these Terms and Conditions. A later change requires agreement; this does not limit the participant's statutory rights. Non-attendance, late arrival or early departure does not entitle you to a refund.

This withdrawal or cancellation form is provided for convenience only; you may send a regular email instead.
Please use the word “Cancellation” as the email subject line.
A signature is required only for the paper version.

§ 4. Changes and Cancellation of the Festival

1. If an instructor is ill, travel is disrupted or there is a safety risk, the Organiser may change the order of sessions or the room, or provide an equivalent substitute, without materially reducing the value of the programme. The Organiser will communicate changes promptly by email and/or by publishing the relevant information on the website and/or through social media channels.

2. A change of date, relocation outside Dojo Stara Wieƛ, cancellation of a key part of the programme or removal of an important service from the offer is a material change. Before the Festival starts, you may accept it or terminate the contract and receive a full refund. Silence does not mean consent. If a material change occurs during the Event, you are entitled to a financial settlement for the part not provided and retain any further rights under the law.

3. If the Festival is cancelled before it starts, the amount received by the Organiser will be refunded, but will be reduced by the Organiser's justified, documented and non-recoverable costs, including in cases of force majeure. This does not exclude any other claims to which you may be entitled. Transferring the payment to a new date requires the buyer's consent.

§ 5. Touch and Safety

1. Every exercise is voluntary. You may observe, change partners, decline or stop without giving a reason. Declining an individual exercise does not exclude you from the Festival.

2. Before each exercise, agree with your partner on the touch, its location and intensity. Consent must be ongoing and may be withdrawn at any time without giving a reason. Applying pressure, for example, despite persistent requests to desist, is unacceptable and may result in removal from the Event. The word STOP, moving away or any other signal of refusal means that the exercise must stop immediately; silence is not treated as implied consent.

3. Use only techniques demonstrated by the instructor, within the agreed scope. Sexual behaviour and touching the genitals, perineum or breasts are prohibited. Do not pressure others to go beyond their boundaries or disclose information entrusted to you by your partner.

4. Adjust your effort to how you feel and to your own abilities. If you have health concerns, consult an appropriate specialist about participation. Do not exercise during an acute infection, under the influence of alcohol or intoxicating substances, or in a condition that puts you or others at risk. Pain, dizziness, shortness of breath or severe discomfort are signals to stop and speak to the instructor.

5. It is sufficient to state the necessary restriction, for example "no pressure on the knee"; you do not have to disclose a diagnosis to the group. You may confidentially request an adjustment using Annex 3.

6. Keep your hands clean, nails short and clothing clean, and do not wear jewellery that poses a risk. Follow the instructions of the instructor, who explains safe practice, supervises it and may stop an unsafe exercise or suggest observing instead.

7. Immediately report an injury, faintness, a boundary violation or a risk to the instructor or the Organiser. In an emergency involving a threat to life or health, call 112.

§ 6. Conduct, Venue and Liability

1. The Dojo rules in Annex 1 and lawful instructions concerning safety, evacuation and hygiene apply.

2. Violence, harassment, discrimination, unwanted touch and disruption of sessions are prohibited. A serious or persistent breach may result in exclusion, proportionate to the risk. Where circumstances allow, a warning and an opportunity for the participant to be heard will be given first. Conduct of this kind may result in forfeiture of the entire payment; any financial settlement for the part not provided will take into account only legally justified claims.

3. Participants are liable for damage caused by their fault in accordance with the law. The Organiser is liable in accordance with the law, including for proper performance of the contract and for the persons it engages to perform it. Neither these Terms and Conditions nor the declarations constitute a waiver of statutory rights.

§ 7. Photographs and Materials

1. The Organiser may record and publish the Participant's recognisable image, voice and statements within the scope of the voluntary consent as described here:
The participant hereby consents to the processing of selected data by the Organiser identified in § 1 (without remuneration) and authorises their recording and publication in coverage and promotion of the 1st Global Shiatsu Festival.
This includes the Participant's image in photographs, their voice and statements in audio and video recordings, as well as their first and last name alongside approved material on the Festival website, in the Organiser's newsletters, in the Festival's printed information materials, as well as on social media within the normal bounds of the Festival remit.
This consent does not cover sponsors' own advertising or the disclosure of health data.
Materials must not infringe dignity or alter the meaning of statements.
The Organiser will comply with its GDPR obligations to erase data and inform recipients.

2. Participants may not record lectures without the instructor's consent or other people without their consent. Recording in the cottages, changing rooms, sauna or situations that infringe privacy is prohibited. Training materials are for personal study; any further use requires a legal entitlement or the author's consent. This does not restrict uses permitted by law or the use of ideas and methods themselves.

§ 8. Complaints, Online Registration and Governing Law

1. Send complaints by email or post to the address in § 1. Describe the problem and the solution you expect; providing the order number will help us handle the complaint. The Organiser will respond on a durable medium, such as email, within 14 days of receipt. Failure to respond to a consumer's complaint within the statutory period means that it is accepted, in accordance with Article 7a of the Polish Consumer Rights Act.

2. Consumers may seek help from a consumer ombudsman, the Trade Inspection or the European Consumer Centre. The Office of Competition and Consumer Protection (UOKiK) provides information on out-of-court dispute resolution. If a complaint remains unresolved, the Organiser will provide, on a durable medium, its position on participation in such proceedings and the required information about the competent entity.

3. The registration form is a free electronic service: it starts when you begin using the form and ends when you submit or close it. You need internet access, an up-to-date browser and an email address. Do not submit unlawful content or other people's data without authorisation. Protect your email account and check the website address to avoid scams. Complaints about this service are handled as described above.

4. Polish law applies, without limiting the consumer protection provided by applicable mandatory rules. Disputes will be heard by the court having jurisdiction under the law.

§ 9. Privacy Policy - GDPR Information Notice

Controller: the Organiser identified in § 1. Contact: [email protected]

What We Use Data for and How Long We Keep It.

Contract and contact.

We use your first and last name, email, order, payment and package details for registration, performance of the contract and settlement of payments (Article 6(1)(b) GDPR). If another person purchases your place, the basis for handling your participation is our legitimate interest in fulfilling the booking (point (f)).

Accounting and claims

We retain tax documents under Article 6(1)(c) GDPR, generally for 5 years from the end of the year in which the tax payment deadline expired. We retain contract details, correspondence and evidence of consent to establish or defend claims (point (f)): until the applicable limitation period expires, usually 3 or 6 years; if there is a dispute, until its final resolution and settlement. We retain them longer only where legally required. We also handle complaints under point (c).

Adjustments

We process information about needs that reveals health data or other special categories of personal data to provide the agreed adjustment, based on explicit consent (Articles 6(1)(a) and 9(2)(a) GDPR). We delete it when consent is withdrawn and no later than 30 days after the Festival. Exception: data necessary for legal claims (Articles 6(1)(f) and 9(2)(f)). Ordinary meal preferences are handled as part of the contract.

Emergencies

We may disclose data necessary to protect life or health to emergency responders (Article 6(1)(d) GDPR). For health data, we rely on Article 9(2)(c) only where the person is physically or legally incapable of giving consent.

Image use and marketing

Separate consent (Article 6(1)(a) GDPR) permits Festival coverage and promotion until consent is withdrawn, but no later than 20 June 2032. We send a newsletter about events and training to an email address provided voluntarily, following separate consent, including the consent required by Article 398 of the Polish Electronic Communications Law. The service continues until consent is withdrawn by emailing the Organiser to unsubscribe.

Do You Have to Provide Data?

Booking and contract data are contractually required: without them, we cannot process your purchase. Tax data are required by law. All other data and consents are voluntary. Do not enter diagnoses in the sales form.

Data Recipients, Sources and Transfers

Necessary data may be received by registration, payment, email and hosting providers, accountants, advisers, the Dojo manager and caterers for services ordered, authorised coordinators and instructors for adjustments, and authorised services and public authorities. Service providers act under appropriate agreements or as separate controllers. We do not disclose the participant list and/or participants' data to third-party individuals or entities unless necessary to provide the service.

We receive identification, contact and booking data from you or the person purchasing your place. Unless you already have this information notice, the Organiser will provide it to you no later than its first contact with you or the disclosure of your data, and within one month of receiving the data.

Data recipients and data transfers outside the EEA:

Participants’ personal data may be disclosed to providers of registration, payment, email and hosting services, entities providing accounting and advisory services, and — in connection with the services ordered — the Dojo manager and catering providers. Authorised coordinators and workshop leaders may access the data in order to provide the adjustments requested by participants. Each of these individuals and organisations receives only the data necessary to carry out their Festival-related tasks. Data may also be disclosed to authorised authorities on the basis of and within the limits of applicable law.
Some recipients of the data are located outside the European Economic Area. Detailed information on such transfers, including the destination countries, the legal basis for the transfer and the safeguards in place, can be provided on an individual basis by email.

Your Rights and Cookies

Subject to the conditions of the GDPR, you have the right to access, rectify and erase your data, restrict processing and obtain data portability. You may object to processing based on legitimate interests on grounds relating to your situation; you may always object to direct marketing. You can withdraw consent as easily as you give it, including by email; this does not affect the lawfulness of earlier processing. You may lodge a complaint with the President of the Polish Personal Data Protection Office (UODO) or another competent authority, for example in your country of residence. We do not make decisions producing legal effects based solely on automated processing, including profiling.
Website logs, such as IP addresses and connection times, are used for website security (Article 6(1)(f) GDPR) for up to 30 days, or longer only when investigating an incident or dealing with a claim. Cookies necessary for the service requested do not require consent. Analytics, advertising and similar tools are activated only after the user makes a choice; refusing and withdrawing consent are as easy as giving it. For more information, consult our Cookie Policy.

§ 10. Acknowledgement of Participation Rules

The Participant hereby confirms that they are at least 18 years old, have read these Terms and Conditions and accept the participation rules, understand the educational nature of the Festival and that it does not replace medical services, agree to follow hygiene requirements, venue rules and safety instructions.
Before touching another person, the Participant will agree on the scope of touch with them and stop immediately upon any signal of refusal.
The Participant understands that they may decline or stop any exercise and will report any injury, risk or boundary violation.
This is not a health certificate, consent to unrestricted touch or a waiver of claims.

§ 11. Notification of Special Needs

If the Participant needs an adjustment for special needs, it is their duty to inform the Organiser. A practical instruction is sufficient. There is no need to provide a diagnosis. Simply inform the Organiser of the required adjustment required and/or what to avoid.
The Participant thereby explicitly consents to the processing by the Organiser identified in § 1 of the health data or other special categories of personal data provided here, solely to agree and provide the adjustments needed for their participation. To the extent necessary, these data may be received by the authorised coordinator, instructor, venue or caterer implementing the adjustment.

Consent is voluntary and is not a condition of purchase. The Participant may withdraw it by emailing the Organiser, without affecting the lawfulness of earlier processing. The data will be deleted when consent is withdrawn, and no later than 30 days after the Festival; retention for legal claims is permitted only on the terms set out in § 9.
